Can Expats Buy Real Estate in Kuwait? Legal Rules & Designated Zones

Real estate ownership in Kuwait is governed by strict statutory frameworks aimed at preserving national housing stock while accommodating diplomatic, corporate, and selective foreign investments.
Under Decree-Law No. 74/1979 (and modern updates under Decree-Law No. 7/2025), the simple answer is: Individual expats face heavy restrictions, but corporate and institutional foreign investors now have expanded avenues for property ownership.
1. Rules for Individual Foreign Buyers
For individual foreign citizens looking to buy residential real estate, Kuwait enforces some of the strict property laws in the Arabian Gulf region:
A. Non-GCC Foreign Nationals
Generally, non-Arab foreign expats cannot directly purchase or own private real estate in Kuwait.

The Rare Exception: Individual ownership for non-GCC Arab nationals is permitted under extremely specific conditions:

Long-Term Residency: Must hold legal residency in Kuwait for at least 10 consecutive years.

Reciprocity: The buyer’s home country must grant Kuwaiti citizens reciprocal rights to buy property.

Cabinet Approval: Approval must be granted by the Kuwaiti Council of Ministers via a formal No-Objection Certificate.

Single Property Limit: The buyer can own only one single property strictly designated for personal residential use (max size: 1,000 square meters). Commercial trading or renting out the property is illegal.

B. GCC Citizens (Saudi, UAE, Qatari, Omani, Bahraini)
Citizens of the Gulf Cooperation Council (GCC) enjoy near-equal property rights as Kuwaiti nationals. They can acquire residential real estate for personal use without needing special ministerial waivers.

2. Institutional & Foreign Business Ownership (Decree-Law No. 7/2025 Reforms)
To stimulate foreign direct investment, Decree-Law No. 7/2025 expanded real estate rights for international businesses and entities:

KDIPA-Licensed Companies: Entities licensed under the Kuwait Direct Investment Promotion Authority (KDIPA) can purchase property directly to build or operate corporate headquarters, industrial sites, or staff accommodation.

Investment Funds & Listed Firms: Boursa Kuwait-listed firms and licensed real estate investment funds with foreign partners are permitted to hold commercial and investment real estate assets.

Restrictions: Properties bought under corporate channels must be tied to active operational goals and cannot be used for speculative residential trading.
3. Designated Real Estate Zones & Classifications
In Kuwait, land and real estate are classified into three major municipal categories:

Status: Strictly reserved for Kuwaiti families and GCC citizens. Foreign individual buyers are barred from buying villas or private plots in these suburban neighborhoods to preserve local housing supply.

Status: Designated for high-rise apartment complexes, commercial units, and corporate rentals. Non-GCC expats with cabinet clearance or institutional investors operate primarily within these commercial sectors.
